The below terms apply to non-commercial work for private use. For commercial work, please get in touch so a contract may be negotiated. For independent creators working on self-published projects, please get in touch as well. A contract may or may not be necessary depending on the scope of your project.
1. Description of delivered artwork
1.1 By default, artwork will be delivered as a .png-file at 360dpi and DINA4 dimensions. However, different dimensions (eg. US print standard or custom dimensions) can usually be delivered upon request.
1.2 If the artwork is intended for print use, reliable information on the desired dimensions (incl. bleed), file type and colour profile is required beforehand. Since different printers work with different specifications, it cannot otherwise be guaranteed that the artwork comes out as intended after printing.
1.3 The artist may refuse to accept any commission for any reason.
2. Workflow
2.1 Turnaround time for a single artwork is usually 1-2 weeks, but depending on the scope of the project and how quickly work in progress stages are approved, it may be significantly longer. Individual estimates are available upon request but will remain estimates. Set deadlines can be negotiated if necessary and realistic for the artist.
2.2 For check-ins, the artist will provide work in progress shots at least once depending on the scope of the artwork, usually for the rough sketch or concept, lineart and colour or final touchup stages.
2.3 During check-ins, revisions can be requested but only as long as they can reasonably be done at the respective stage of the artwork (for example, once a composition sketch has been approved, composition will not be revised during the colouring stage). Revisions that would require redoing large parts of an artwork after the initial sketching stage will usually be denied or charged for. In case the customer is unfamiliar with the art process and is unsure what kind of revisions they can expect or would prefer a contract on the matter, that can be discussed free of charge before a commission is accepted.
2.4 If a deadline has been set but cannot be met because the customer does not reply to checkup emails, the deadline automatically extends to make up for it.
2.5 Estimates for a project’s turnaround time usually count in eventualities like the artist falling sick. Should unforeseen events still prevent the artist from meeting a deadline that had previously been agreed upon, the customer will be notified. This has yet to happen.
2.6 Communication is done via email.
3. Rights granted
3.1 Commissions are for private use. The artist retains full copyright over the artwork and is free to use it to promote their business. However, the customer (or if applicable, a third party) retains full copyright over the character depicted and any design work done beforehand.
3.2 The customer is free to use the delivered artwork for non-commercial purposes, including printed or online media, for example as header or icons, or change or adjust it for any of these purposes, or post it to social media, closed or semi-closed spaces like Toyhouse or Discord. Credit to the artist is appreciated but not required in these instances. The artist can provide a glazed version of the artwork for online use upon request.
3.3 The customer is, however, not allowed to sell the artwork further, nor are they allowed to change and adjust it for commercial purposes without asking for permission and discussing the terms beforehand. That includes but is not limited to: printed or online media like books, magazines, games or merchandise of any kind. Additional licensing fees for these purposes can be discussed upon request but will vary depending on the intended purpose, and may or may not require a contract.
3.4 Artwork is not allowed to be used in any blockchain-related technology under any circumstances. That includes but isn’t limited to being tokenised and minted as NFTs. This prohibition also extends to any future inventions that use blockchain technology or are linked to cryptocurrencies. This is not negotiable.
3.5 Artwork is not allowed for use to train generative AI software of any kind or be altered by it under any circumstances. This is not negotiable, either.
3.6 Any violation of these terms will be considered an automatic purchase of unlimited commercial rights and invoiced accordingly.
4. Payment
4.1 Payment is possible via direct bank transfer, Paypal and Payoneer. However, since Paypal charges the seller significantly higher fees than other money transfer services, that will reflect in higher commission prices.
4.2 If none of these options is viable due to the customer’s location, then other payment methods can be negotiated if need be. Cryptocurrencies are not accepted under any circumstances.
4.3 A final estimate depending on the customer’s preferred payment method and, if necessary, other custom terms and conditions, will either be offered before accepting a commission or during the sketching/conceptualising stage. In both cases, there is no pressure for the customer to accept. However, once the customer agrees to the price and terms, they will receive an invoice. For bank transfer, the invoice will be delivered via email.
4.4 Payment is usually due after about 2 weeks. Payment plans can be negotiated upon request.
4.5 An additional 10% late fee applies in case the customer misses an agreed upon payment date.
4.6 No refunds.
4.7 All payment will be done in €.
5. Summary of most important terms
5.1 Commissions are for private and non-profit use. Usage in commercial projects requires negotiating a contract and license fees with the artist.
